Fatal shooting by trooper justified, prosecutor says

HERSEY, Mich. (AP) - (11/19/15) - A prosecutor says no charges will be filed against a state trooper in a fatal shooting last summer in Osceola County.

Eugene Kailing of Hersey was killed in July in Highland Township, about 15 miles southeast of Cadillac. Witnesses said he was rushing at a trooper with a metal fence post.

Osceola County Prosecutor Tyler Thompson says the deadly force was justified after the 43-year-old man wasn't stopped with a Taser. At the time, state police said the trooper found a car on its side, up against a house, and a man running around.

It was near the intersection of M-115 and 20 Mile Road. The trooper's name wasn't released.
