Genesee County attorney faces five charges in email case

GENESEE COUNTY (WJRT) -

(04/18/12) - A longtime Genesee County attorney now faces five felony charges stemming from allegations he illegally accessed his former employee's emails.

Only ABC12 was in court Wednesday morning when he was arraigned.

The case is being prosecuted by Tuscola County Prosecutor Mark Reene.

Genesee County Prosecutor David Leyton recused himself.

Attorney Steven Spender is charged with five felonies, accused of illegally accessing a former female employee's emails during a period of about six months last year.

Spender, a senior partner at Spender & Robb in Flint Township, according to the firm's website, faces three counts of unauthorized access to a computer and two counts of interfering with electronic communications.

Reene said there was conduct, on Spender's part, above and beyond email accounts he was authorized to access.

"We are trying to work out a disposition that would make all parties happy," said defense attorney Dennis Lazar in court.

Lazar, and even Spender himself, asked 67th District Court Judge David Goggins that he be allowed to still use a computer for work purposes.

"In other words, I won't access the Internet, but if I could access the server in my office?" asked Spender.

But Goggins ordered no direct computer access, no digital tablet or iPad access and Spender can only use his smart phone to make phone calls.

Lazar declined to comment, saying he hadn't even seen the police reports yet.

Bond was set at $2,000 cash or surety on each count.

Online court records indicate he did post that money.
