(07/27/12) - The trial for a former Buena Vista Township police officer accused of killing his pregnant girlfriend will be held in Saginaw County.
That was one of several legal rulings that came out of a court hearing Friday morning in the case of Ken Bluew.
A judge has also issued a gag order until the trial begins.
Change of venue for the trial was one motion, but there were other key rulings as well, concerning statements the victim made about her relationship with Ken Bluew.
Bluew was back in court, and his future court proceedings in this case will be conducted in Saginaw as well, as Circuit Court Judge Darnell Jackson denied a motion to move the trial out of Saginaw County.
Bluew's attorney, Rod O'Farrell, asked for the change of venue because of the coverage the case has received. It was last August when the body of 32-year-old Jennifer Webb was found near her vehicle on Outer Drive in Buena Vista Township.
Bluew was one of the first officers on the scene.
The death was first investigated as a suicide, but that changed as investigators learned Bluew and Webb were in a relationship, and that Webb was pregnant with Bluew's child. O'Farrell gave an indication that his client maintains Webb killed herself.
"Her state of mind is an issue. There is an issue in this case in terms of cause of death, in terms of suicide," O'Farrell said.
Judge Jackson also ruled on which statements pertaining to Bluew and Webb's relationship would be admissible in court.
Assistant Prosecuting Attorney Jeff Stroud argued that certain statements Webb made to people who will testify at trial should be allowed, because it shows she was planning on the future, and not contemplating suicide.
"Her intent to seek child support, her intent to put his name on the birth certificate," Stroud said.
Judge Jackson ruled the evidence of those intentions will be allowed, along with statements Webb was planning on meeting Bluew that night she died, and that Webb had told Bluew he was the father of her unborn child.
The trial is scheduled to begin Sept. 19.
