State Board of Canvassers to take up EM issue Wednesday

(08/07/12) - Flint Emergency Manager Mike Brown could be out of office as early as Wednesday.

The State Board of Canvassers will meet then to consider certifying the emergency manager referendum for the November ballot.

This is the next step following last weeks developments.

The state Supreme Court ruled the board must certify it.

It is the latest and likely last step in the battle to get a referendum of Public Act 4, the state's emergency manager law, on the November ballot.

It follows months of back and forth, which saw protests on the steps of the Capitol.

Petitions to place the issue on the ballot were rejected in April because of font size.

The State Board of Canvassers deadlocked on the issue when it went to them for a vote.

But it's back to the board Wednesday afternoon, then back to the state's previous, less powerful, emergency manager law once the referendum is certified.

Flint Emergency Manager Mike Brown is then out.

"Because Mike served as mayor within the last five years, he's not eligible to serve as the EFM under Public Act 72," said state Treasurer Andy Dillon Friday.

Brown will help with the transition.

A spokesman for the state Department of Treasury says the Local Emergency Financial Assistance Loan Board will name a replacement.

It is scheduled to meet Wednesday afternoon, after the Board of Canvassers do.
