Charges issued in case involving HIV positive Flint man

GENESEE COUNTY (WJRT) -

(09/11/12) - Charges have been issued against an HIV positive Flint man. They stem from allegations he did not inform two sexual partners about his status.

Not disclosing your positive HIV status to partners is a crime in several states - including Michigan.

A warrant was signed in court, Monday, charging 44-year-old Jonnie Peters with two felony counts of AIDS - sexual penetration with an uninformed partner. The counts stem from alleged sexual contact in 2007 and 2010.

Genesee County Sheriff Robert Pickell and Health Officer Mark Valacak outlined the case at a news conference Tuesday morning.  

Peters has not been in court to face the charges.

ABC12 would not typically identify him until then, but health officials fear others could be affected.

"We think there are a lot of victims out there," Pickell says.

Authorities want people to be aware and to get tested if they have had sexual contact with Peters or one of his known partners.

ABC12 interviewed Peters last month. He was the director of a new community center in Flint. He no longer works there.

Tuesday, we spoke by phone.

Peters admits being HIV positive, but says he's been truthful with his partners.

Authorities dispute that.

"We were aware Mr. Peters was positive," Valacak says. "We had an individual, newly identified as HIV positive, who identified Mr. Peters as a partner, but indicated him as a partner who was negative."

"When we had a second case come up, we were concerned again," Valacak says.

Valacak says, in November, the Genesee County Health Department issued Peters a compliance notice and then proceeded legally.

The Sheriff's Department investigated.

Pickell says the investigation shows Peters had "multiple" male partners.

Pickell and Valacak both say four men have been identified so far.

"Our recommendation is that anyone who has had a sexual relationship with this man be tested," Valacak said.

Peters is in custody.

He is expected before a judge Wednesday.

Genesee County Prosecutor David Leyton says his office has issued charges like this only once before - in 2009.
