Testimony begins in hearing for suspects charged in security guard's murder

FLINT (WJRT) -

(03/07/13) - Testimony is underway in a court hearing for two Flint men charged in the August 2010 armed robbery and murder of security guard John "Andy" Mick.

Mick was working for LaGarda Security and was on duty at Flint's River Village Apartments when killed.

Floyd Perkins and Kenya Hyatt, 21 and 19, were just recently charged. This hearing determines if there is enough evidence to send them to trial. It started Thursday.

Detective Sgt. Terence Green, who took at a look at the case in late January, testified Thursday that a confidential informant had previously identified Perkins as a person of interest in Mick's murder.

When Perkins showed up in jail on an unrelated case, last month, Green interviewed him.

"He told me, he and his cousin had planned the robbery," Green said. Green, who is retired from the Genesee County Sheriff's Department, now works for University of Michigan Flint Public Safety and is assigned to the Genesee County Prosecutor's Office.  

"The intent was to rob Mr. Mick of his service revolver," Green said.

Green said Perkins told him he needed protection, needed a gun, so Perkins and his cousin Hyatt plotted to rob Mick.

"They used a ruse of an unknown drunken person, in the parking lot, to lure Mr. Mick out of his security guard patrol vehicle," Green said.

Green said Perkins claimed to have attacked Mick from behind while Hyatt pointed a rifle at his chest. 

Green also interviewed Hyatt.

"During the struggle, Mr. Mick grabbed the rifle that he was pointing towards Mr. Mick's chest," Green testified.

Green said Hyatt said the gun accidentally discharged - four times total.

According to Green, Hyatt and Perkins said they hadn't planned to hurt Mick.

Green said Perkins told him he did take Mick's gun from a holster on his belt and then took off after the first shot fired. Perkins said Mick was still breathing and he heard three more shots fired as he was running away, according to Green.

When police arrived?

"The victim was found laying on his back in the parking spot, the empty parking spot, next to his vehicle," testified Flint Police Sgt. Todd Pillsbury. He was a patrol officer at the time and responded to the scene.

The two guns, believed to be involved in Mick's murder, have not been found.

The hearing is scheduled to continue next week.
