Man pleads "no contest" in deadly 2010 Genesee Twp. crash

GENESEE TOWNSHIP (WJRT) -

(03/13/13) - The sole survivor of a deadly 2010 car crash, in Genesee Township, has reached an agreement with prosecutors and will be sentenced soon.

Police say Bay Gurd, who did not have a driver's license, ran a stop sign at the corner of Carpenter and Belsay Roads the night of Oct. 27.

His own wife, Khadijah Saaba, was killed, as were husband and wife Angela and Robert Stanton II of Genesee Township.

"My mom was just the all around best person," said Brooke Stanton. "My dad was the biggest fisherman you'll ever meet in your entire life."

It's been two and a half years of heartache and huge life changes for their family.

"I was in the Navy when it happened. I was actually out to sea," said Robert Stanton III.

Brooke was just 17 and a senior in high school when they were killed. She is one of four children, the youngest, and now has a 4-month-old son of her own.

"All my advice was supposed to come from my mom," Brooke said.

Robert moved home to care for Brooke.

"(You) just got to figure out a way to get through it and carry on how you think they'd want you to carry on your life," he said.

The next chapter of it includes seeing the man accused of killing their parents sentenced to prison.

Gurd pleaded no contest to one count of driving while license suspended causing death, Monday. Two other charges and drugs charges, issued last year, have been dismissed as part of the deal, too.

The family signed off on the agreement after careful consideration with prosecutors.

"If I didn't think (Assistant Prosecuting Attorney) Vikki (Bayeh) Haley had done the best job she could, then I wouldn't be satisfied," said Angela's sister Laura Kinney. "But she did the best she could and now it's up to the judge."

Gurd must spend at least four years and up to 15 in prison. He will be sentenced next month.

The Stanton family said they don't want to hear anything from him at his sentencing hearing. They just want to see him locked up and unable to hurt anyone again.

They said he shouldn't have been driving. Gurd's wife and passenger, a mother to six children, was killed, too.

"It could all have been prevented and so easily prevented," Brooke said.
 
The Genesee County Road Commission has made a number of safety improvements at that intersection, including adding additional, larger stop signs and reflective tape.

Gurd's attorney, Frank Manley, says his client is remorseful.

"It's tragic, He lost his wife and now he'll lose precious time with his kids," Manley said.
