(03/19/13) - A Mid-Michigan attorney says signs on the doors of a public building is a violation of his second amendment rights. The sign warns that no weapons are allowed inside.
The red signs have been on the doors to the Genesee County Administration Building for years - "no weapons beyond this point." But an attorney thinks that infringes on his right to bear arms.
"I think it's very confusing and very ominous to anybody who is a law abiding citizen," said K.C. Baran.
He has sent a letter to the Genesee County Board of Commissioners asking that the signs be removed.
"I think it's important that those of us who are law abiding citizens, who have concealed carry permits, who want to carry legally should be allowed to do so in those areas that should be open for that purpose," Baran said.
The chairman of the board of commissioners has turned the letter over to county attorneys for their advice.
"One thing we really don't want to do is be in non-compliance on people's rights. No matter what side of the issue you're on regarding the Second Amendment, the laws are the laws. We're here to comply with the laws," said Jamie Curtis, chairman of the Genesee County Board of Commissioners.
One issue that could complicate matters is the Friend of the Court offices, which are located here.
Legally speaking, the Friend of the Court is an extension of the court system and is considered a weapon free zone. But because the rest of the county administration building is open to the public, it could be legal to carry a weapon.
There are no metal detectors or police officers at the entrance to enforce the ban. Both sides think a compromise can be reached.
"We just want to make sure that what we're doing is proper and we don't end up in a frivolous lawsuit over this," Curtis said.
"I'd like to see this issue resolved amicably so no court battle is brought up," Baran said.
