(08/15/13) - He fought in the Korean War more than 60 years ago.
Now, a Saginaw man wants justice after being beaten and robbed in his home three months ago.
Even though three people were arrested after they were found were in the man's SUV, no one has been criminally charged.
Since this vet has been robbed, his garage has been broken into several times. His family is concerned about his safety.
John Benway faces health challenges at age 86. As he fights cancer, he also fights to see his attackers put behind bars soon.
"There were three of them, they had scarves around their face," he said.
That's what Benway remembers about the robbery on May 15. He was knocked to the floor, then held at gunpoint while thieves made off with TV's, guns, money and Benway's SUV - with a wheelchair rack on the back.
One day later, our camera was rolling as police found the SUV on Webber Street, with three people inside.
"Caught red handed and let go, it just doesn't seem right," said Dennis Jones, John's son.
Jones says he was told all three were released about 48 hours later for what investigators called a lack of evidence.
"They caught all three guys in the car, and they sat there, they had my dad's drivers license," he said.
Saginaw Police say that investigation is still open, and they are waiting for test results, including fingerprint analysis, to come back from the State Police Crime Lab. Meanwhile, Jones believes the suspects have returned to the scene of the crime.
"They've been back to or three times now," he said. "They went through the shed, the garage."
More items were stolen.
"Something has got to be done, something, I don't know, I think we laid off too many policeman," Benway said.
Benway is referring to Saginaw dropping its police staffing level to 55 officers. He says two guns stolen in that first robbery are still missing, but he bought another, and is determined to stay in his home.
"I don't want to kill anybody. I will, because I'm an old soldier, they ain't messing with me no more," he said.
Police says it's the prosecutor's office which has requested more evidence, in particular those reports from the crime lab.
We were not able to get in touch with someone in that office that was familiar with this case.
