(12/02/13) - Flint City Attorney Pete Bade will appoint a special, assistant city attorney to handle councilman Eric Mays' case and it won't be anyone from the city attorney's office. 

Mays could face drunk driving and drug possession charges following his arrest over the weekend.

Bade said the appointment could happen Tuesday.  He's recusing himself and his office to avoid the appearance of any potential conflict of interest.    

Something else to look for Tuesday, a recount connected to the votes that got Mays elected to the First Ward seat in November.  He beat Anita Brown by just seven votes.  Brown requested the recount.  It was ordered last week prior to his arrest.

Flint Police say Mays hit something early Saturday morning and then drove the wrong way down I-475 with four flat tires.  Flint Police said he didn't have proof of insurance and wouldn't submit to fingerprinting either.

Mays' attorney Frank Manley said unless voters speak, Mays will remain on city council.

"Once you get past the who to the what, you realize these are, at worst, misdemeanor charges," Manley said, and that's if the allegations can even be proven.

Manley said he doesn't think Bade should be able to pick who prosecutes the case. 

Fellow city council members have declined comment, but councilman Bryant Nolden did confirm Mays did attend a party he helped host Friday night.

Nolden said he'll be praying for Mays.

Flint residents seemed mixed on the situation.

One man who declined to give his name said, "(No) sooner he got on there (city council) then he get in trouble, what kind of stuff is that?"

Another man who also declined to provide his name said, "It don't matter to me."

"People allowed (sic) to make mistakes," said Gary Grundy.  "He not (sic) smoking crack."
