Eric Mays stays as Flint's First Ward Councilman

FLINT (WJRT) -

(12/03/13) - Flint's First Ward election recount is over and Councilman Eric Mays does get to keep his seat.

Mays beat his opponent, Anita Brown, by just seven votes in last month's election and gained one more vote Tuesday morning.

Genesee County Elections Supervisor Doreen Fulcher said the final tally has Mays with 710 votes and Brown with 702. Mays stays and wins by eight votes.

"I'm blessed," said Mays.  "It's a needed victory at this time."

Brown requested the recount, in part, because the numbers were so close, but also because she believes there were transparency issues at the polls.  The Genesee County Board of Canvassers granted the recount request last week.

Flint City Clerk Inez Brown has said Brown didn't report anything underhanded election day.

After the recount Tuesday?

"I just wanted it to be fair and transparent and that's not something that we experienced today," said Brown.  "I believe that it's very coincidental that the box of absentee ballots, that covered all the wards, were not made available to be counted.

The absentee ballots, 526 of them, were not recounted Tuesday because the seal numbers on the ballot can did not match the seal numbers on the poll book from election night, Fulcher said.

Fulcher said state law prohibits cutting the seal if the numbers don't match.

The Genesee County Board of Canvassers had the recount results in under two hours.

"I want this position and I'm glad that not only did the recount hold up, but I picked up a vote.  I needed that positive spin right now," Mays said.

He declined comment on his drunken driving and marijuana possession arrest over the weekend.

Flint City Attorney Pete Bade recused himself and his office from prosecuting the case.  Bade appointed Michael Gildner to handle it.
