Man who shot at MSP trooper in Saginaw appears in court

(12/20/13) - Friday, we got our first look at the man accused of shooting a Michigan State Police trooper in Saginaw.

The shooting happened in October.

Investigators say the trooper's bullet proof vest may have saved his life.

As we reported earlier, Manuel Hernandez was a parole absconder when police were called to a west side neighborhood in Saginaw on Oct. 10.

Hernandez walked in to a Saginaw County courtroom for the first time since the shooting. He is charged with assault with intent to murder the trooper.

The first witness in the case was Mark Scott of the Saginaw Police Department. He says he was called to the 2200 block of Stark, for a report of a gunshot fired.

He says he saw Hernandez run from the area, and then a short time later, Scott heard a series of gunshots a few blocks away on Davenport.

Scott testified as to what he saw when he got to the area where he heard the gunshots.

"Found Trooper Short standing near the sidewalk, had his gun drawn, there was a suspect on the ground that had obviously been shot. There had also been some radio traffic broadcast from Trooper Short advising that there had been shots fired and that he was shot and so was the suspect," Scott testified.

The state trooper who was shot, Jeff Short, also testified.

He explained the moment he exchanged gunfire with the man.

"I ordered him to get on the ground at that point and the subject did not get on the ground, he just turned and looked in my direction and started reaching for his right pocket. At that point I'm just yelling at him to get his hands out of his pocket. 'Don't put your hand in your pocket.' The subject reached into his pocket, and at that point, I'm just waiting to see if that is in fact a gun that he was pulling. Next thing I know, I just see his hands going this motion. I see the gun and a muzzle flash go off and now he is shooting at me," Short testified.

Hernandez was injured in the shooting.

Short has returned to duty.

District Court Judge Randall Jurrens found there was enough evidence to bind Hernandez over to circuit court.
